Terms of Service
The agreement between you and SalesTrak governing your use of our website, web app, and mobile apps.

1. Acceptance of these terms
These Terms of Service ("Terms") are a legal agreement between you and Bartlett Roofing ("SalesTrak," "we," "us," or "our") governing your access to and use of the SalesTrak website at salestrak.io, the SalesTrak web application, and the SalesTrak mobile apps for iOS and Android (together, the "Services"). By creating an account, accepting a Workspace invitation, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
If you use the Services on behalf of an organization, you represent that you are authorized to accept these Terms for that organization, and "you" includes that organization.
2. The Services
SalesTrak is a CRM platform for roofing sales teams. It lets your team track leads, jobs, and projects; work a map-based view of properties in the field; log activity and visits; and attach notes and media. We may add, change, or remove features over time.
3. Accounts & Workspaces
- You must provide accurate, current information when creating an account and keep it up to date.
- You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
- SalesTrak is organized into Workspaces. The person or organization that creates a Workspace controls its settings, membership, roles, and content, and is responsible for its members' use of the Services within that Workspace.
- You must be at least 18 years old and capable of forming a binding contract to use the Services.
4. Your data & content
"Customer Data" means the content you and your Workspace submit to the Services — including leads, jobs and projects, customer and property details, addresses, notes, custom fields, and media such as photos, videos, and documents.
- Ownership. As between you and us, you retain all rights to your Customer Data. You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display Customer Data solely to provide and support the Services.
- Your responsibilities. You represent that you have all rights and permissions necessary to submit your Customer Data and that doing so — including recording property information, customer contact details, and photos of job sites — complies with applicable law. You are responsible for the accuracy and legality of your Customer Data.
- Backups. While we take reasonable measures to protect Customer Data, you are responsible for maintaining your own copies of anything critical to your business.
5. Acceptable use
You agree not to:
- use the Services in violation of any law or the rights of others;
- upload content that is unlawful, infringing, or that you lack the right to submit;
- attempt to gain unauthorized access to the Services, other accounts, or Workspaces you don't belong to;
- probe, scan, or test the vulnerability of the Services, or breach any security or authentication measure, except as expressly authorized;
- interfere with or disrupt the integrity or performance of the Services;
- reverse engineer, decompile, or copy the Services except as permitted by law; or
- resell, sublicense, or use the Services to build a competing product.
6. Mobile app license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the SalesTrak mobile apps on devices you own or control, solely to access the Services. Your use of the apps is also subject to the applicable app store's terms (the Apple App Store and Google Play). Where those store terms require it, the applicable store is a third-party beneficiary of this license. SalesTrak, not the app store, is responsible for the app and its support under these Terms.
7. Plans & fees
SalesTrak currently offers a free plan; see our Pricing page for current offerings. If we introduce paid plans or features, we will disclose the applicable fees and billing terms before you incur a charge, and those terms will form part of this agreement.
8. Intellectual property
The Services, including all software, design, text, and branding (other than your Customer Data), are owned by SalesTrak and its licensors and are protected by intellectual-property laws. These Terms grant you no rights to our trademarks or branding. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them to improve the Services, without obligation to you.
9. Third-party services
The Services rely on and may integrate with third-party services (such as cloud hosting, storage, and mapping providers). We are not responsible for third-party services, and your use of them may be subject to their own terms.
10. Privacy
Our Privacy Policy explains how we collect, use, and share information in connection with the Services. By using the Services, you agree to the practices described there.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR- FREE, OR SECURE, OR THAT MAP DATA, LOCATION, OR OTHER INFORMATION WILL BE ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALESTRAK AND BARTLETT ROOFING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless SalesTrak and Bartlett Roofing and their officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Data, your use of the Services, or your violation of these Terms or applicable law.
14. Term & termination
These Terms apply while you use the Services. You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Services or other users. Upon termination, your right to use the Services ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
15. Changes to the Services or terms
We may modify the Services or these Terms from time to time. When we make material changes to these Terms, we will update the "Last updated" date and provide notice through the Services. Your continued use after changes take effect constitutes acceptance of the revised Terms.
16. Governing law & disputes
These Terms are governed by the laws of the State of Idaho and applicable U.S. federal law, without regard to conflict-of-laws rules. You agree that the state and federal courts located in Ada County, Idaho will have exclusive jurisdiction over any dispute arising out of these Terms or the Services, and you consent to their jurisdiction and venue.
